Worker rights and Obligations


Employed persons and employers must be aware of the rights and obligations of employment. The Employment and Industrial Relations (Cap 452) and the subsidiary legislation issued thereunder regulate worker rights as well as their obligations. TCNs have guaranteed equal working conditions under this Act. This includes working hours, sick leave, and minimum wage, different types of employment contracts, paid leave, notice periods and overtime pay.

This may also be regulated by A Wage Regulation Order  which is subsidiary legislation kept in force under the Employment and Industrial Relations Act that regulates certain conditions of employment of employees working in a specific sector of the industry.

Employers are required by legislation to engage foreign nationals on conditions of work, (ie wages/salaries, hours of work) which are the same for those of Maltese and EU nationals.
